1. Introduction
This proposal is prepared for a Company who is
seeking individuals or firms to undertake the role of Planning
Supervisor in accordance with the Construction (Design and
Management) Regulations 1994.
Haze and Safety offer this service, which incorporates fully the
duties of the Planning Supervisor as required under the
Construction (Design and Management) Regulations 1994.
With the ability to combine its past and present experience of
project management, environmental services, and health and safety
expertise, Haze and Safety is able to offer our client advice and
a service covering all aspects of the new legislation.
The following information summarises the service that Haze and
Safety would provide as the Planning Supervisor under the new CDM
regulations to our clients.
Philosophy
Haze and Safety in the role of planning supervisor,
is committed to promoting a continued appreciation by all parties
that health and safety in the work place is an essential part of
the design and construction process on a project. By promoting
co-operation within the design team and with the principal
contractor, Haze and Safety believe that their proactive approach
in the role as the planning supervisor significantly contributes
to the ethos of developing a safe and healthy environment.

2. Competence and Resources
Although we believe that our document covers all
the points that you may need to address we hereby respond to
specific queries on competence and resource.
a) Membership of a relevant professional body
Haze and Safety are members of the following
professional body:
Association of Planning Supervisors
Our staff hold memberships of the key professional organisations
as described in the response to f) below and, therefore, we are
governed by the rules and guidance required by these professional
bodies.
b) The planning supervisor's knowledge of
construction practice, particularly in relation to the nature of
the project
The experience throughout Haze and Safety includes
project and construction management, environmental services, risk
management, and health & safety.
These services have been offered across the spectrum of the
construction and building industry and cover every aspect of work
from inception, through the design and tendering stage and
thereafter during construction, onto completion and the ongoing
maintenance.
c) Familiarity and knowledge of the design
function
Our Planning Supervisors are drawn from the project
and construction management field who inherently have been
involved with the process of design management and co-ordination.
Notwithstanding this experience, we are able to call on expertise
in any aspect of a project at any time.
d) Knowledge of health and safety issues
(including fire safety issues), particularly in preparing a health
and safety plan
Our experience throughout Haze and Safety including
project and construction management, environmental services, risk
management, health & safety and others has created its
inherent knowledge of individuals being aware of health and safety
issues throughout the construction process.
We are able to develop and issue a Health and Safety Plan either
for tender or for the construction phase. This part of the
appointment is not only restricted to the Plan, but also ensures
that any other documentation is in line with the Regulations.
e) Ability to work with and co-ordinate the
activities of different designers and your expertise in bridging
between the design function and construction work on site
As previously explained above, our Planning
Supervisors are drawn from the project and construction management
who inherently have been involved with project management and
co-ordinating every aspect of the works down to site level.
Notwithstanding this experience, we have individuals who have
particular expertise in different aspects of a project at the
different stages and would be available at the appropriate time to
supplement the nominated personnel.
f) The number, experience and qualification of
people employed, both internally and from other sources, to
perform the various functions in relation to projects
Haze and Safety can call on the resources of
professionally qualified persons from different disciplines to
assist in the role of Planning Supervisor.
These qualifications include membership to the following
professional bodies:
The Association of Project Managers
The Royal Institution of Chartered Surveyors
The British Institute of Management
The Institute of Occupational Hygiene
The Association of Planning Supervisors
The Institute of Safety and Health
We have strategic liaison with external consultants with regards
to specific expertise such as fire safety, environmental
contamination and space planning and will bring in this additional
resource if or when appropriate.
g) The management systems which will be used to
monitor the correct allocation of people and other resources in
the way agreed at the time when these matters are being finalised
We have developed a Quality Management system to
enable the role of planning supervisor to be internally auditable
within the company. Also, we have been able to re-assess the time
commitment needed at each phase of a project to ensure the correct
resource is available.
Haze and Safety warrant that sufficient resource will be made
available at any time to meet the requirements of the role of
planning supervisor in accordance with the Regulations.

3. Scope of the Service
In order to understand the interface with the
Planning Supervisor, it is necessary to outline the different
obligations that would be undertaken at the different phases of
the project.
Concept or Feasibility Phase
Within this phase, the details of the project have
now been outlined, and the client needs to have made some
fundamental decisions concerning the works. It must be remembered
that the CDM Regulations requires that health and safety must be
addressed at this very early stage.
Key tasks during the concept and feasibility stage are:
- Determine whether the project falls within the scope of the
CDM Regulations
- Appoint a planning supervisor
- Be reasonably satisfied that the planning supervisor and any
designer(s) who the client arranges to prepare a design are
competent and have made adequate provision for health and
safety.
- Provide the planning supervisor and designers with
information relevant to the health and safety of the project
With the feasibility stage now completed, we would
highly recommend that the appointment of the planning supervisor
is made as soon as possible. This would enable the appointed
planning supervisor to assist the client by immediately giving
advice on such key issues as, the competence and the adequacy of
the provision for health and safety being made by any designer(s),
ensuring that the designers comply with their duties under the CDM
Regulations and ensuring that health and safety issues are
co-ordinated.
With regard to our own competency, we are able to offer a wide
range of experience in all aspects of the building industry
including environmental services, risk management and health and
safety expertise, and at any time Haze and Safety is able to call
on this diverse pool of support to offer the client advice and a
service covering all aspects of the Planning Supervision.
Additionally, as the planning supervisor, we would undertake the
following tasks at this stage:
- Submit the Notification to the Health & Safety Executive
- If requested, give advice to the client on the designers'
competence and adequacy of resource provision for health and
safety
- Ensure, as far as reasonably practicable, co-operation
between designers
- Ensure, as far as reasonably practicable, that designers
comply with their duties
Design and Planning Phase
The key tasks of the client, and the planning
supervisor during the design and planning stage are similar to
those in the concept and feasibility phase.
The key tasks for the client being:
- Provide the planning supervisor and designers with
information relevant to the health and safety of the project as
this becomes available
- Be reasonably satisfied that any designer(s) who have been
appointed to prepare a design are competent and have made
adequate provision for resources to consider health and safety
in the design development
It is essential that all the information that can
be reasonably made available for inclusion in the Health and
Safety Plan is given to the planning supervisor in order that the
preparation of the Plan can be initiated for inclusion within the
tender documentation.
At this time the client must also be satisfied that the designer
is capable of preparing the design and making due allowance for
health and safety considerations. Together with this, the client
must ensure that sufficient time is being allowed at each stage of
the project, since this is an essential resource that must not be
overlooked or ignored when considering the project duration.
The planning supervisor will continue his previous duties:
- If requested, give advice on the designers' competence and
adequacy of resource to consider health and safety during the
design development
- Ensure designers continue to co-operate
- Ensure designers comply with their duties
- Ensure the pre-tender stage health and safety plan is
prepared
- Ensure the preparation of the health and safety file begins
Essentially, the planning supervisor should be
ensuring that the designers continue to co-operate and take health
and safety issues into account, initiate the health and safety
plan and start developing the health and safety file. Throughout
this period and for the duration of the project, he will give
advice to any party or individual from whom it may be requested.
Tender/Selection Phase
As part of the selection process for appointing a
principal contractor, the planning supervisor would review the
tender returns, with particular regard to ensuring that any
prospective contractor has indicated satisfactorily that he is
competent to carry out the works and that sufficient resource is,
or will be, allocated for health and safety matters.
As part of any tender documentation, prospective
principal contractors would be asked to provide the following
information:
- Their health and safety plan
- An outline submission giving evidence that health and safety
has been adequately provided for in the tender in accordance
with any requirements of the health and safety plan
- A clear specification of the resources that are, or will be,
available to control and manage the health and safety risks
- Evidence of the contractor's competence to carry out the
construction work to the requirements of health and safety
legislation
Following a review of the tender submissions, the
planning supervisor would report to the client on the competence
and resource availability of each of the tenderers in order that
the client can be satisfied that any appointed contractor can
comply with his duties and obligations under the Regulations.
Construction Phase
Following the award of the contract, the client can
have further key duties to fulfil:
- Ensure construction work does not begin until the principal
contractor has prepared a suitable health and safety plan
- Comply with health and safety legislation where his own work
activities or undertakings may be affected by the construction
works
- Be reasonably satisfied that the principal contractor
appointed to carry out the construction work is competent and
has sufficient resources to manage health and safety matters
The planning supervisor, however, ensures that
information is being made available and continues with his
previous duties:
- If requested, advise the client on the principal contractor's
health and safety plan
- Ensure designers continue to co-operate and comply with their
duties
- Ensure that the health and safety file is maintained and
updated
Throughout the duration of the construction works,
as planning supervisor, we would attend design and progress
meetings to review the aspects of health and safety on the
project.
Also, visits to the construction site would enable a continued
review of the principal contractor's ability to manage health and
safety matters competently and that adequate resources are being
made available. Any deficiencies would be reported immediately.
Completion
Upon completion of the works, the planning
supervisor would ensure that all relevant and necessary
information has been collated from the designers and the principal
contractor to enable the health and safety file to be completed
and handed over to the client.
Upon receipt of the file, the client must thereafter ensure that
it is always available for inspection by an interested party.
Essentially, this is the information that is needed for ongoing
maintenance, repairs, cleaning, re-decoration etc. and is also the
information to be supplied at the beginning at any future works.

4. Fee Proposal
Our fee for undertaking the role of Planning
Supervisor in accordance with the Construction (Design and
Management) Regulations 1994 for a specific project will be based
on our appointment being for the contract period and includes for
normal disbursements.
All information and enclosures for the Health and Safety Plan and
Health and Safety File will be supplied by the appropriate parties
free of charge and any other additional searches, reports, drawing
reproduction or investigations etc. required outside the scope of
the planning supervisor's role in accordance with the Regulations
will be subject to reimbursement, any additional fee being agreed
with the client prior to the undertaking of any extra work.
A draw down schedule of payments will be agreed on our being
appointed and thereafter invoices submitted are subject to payment
within 30 days from date of invoice.
An initial visit to site will be undertaken and included in the
fee but should further site visits be required these will be
charged at a rate to be agreed.

6. Quality Management
Throughout the project, Haze and Safety shall use
its own quality management system to monitor its work and enable
their performance to be auditable by any interested party.
However, since our quality management system is flexible enough to
be adapted, we will be pleased to incorporate any system or
specific requirements that the client may have introduced
internally or wish to introduce into future projects.

7. Professional Indemnity
Haze and Safety carry all the necessary and
appropriate public liability insurance cover for performing the
duties of Planning Supervisor in accordance with the Construction
(Design and Management) Regulations 1994.

Mileage will be charged per mile for all distances
over 30 miles (60 miles return)
Standard site visit rates are based on inspection durations of up
to one hour on site. Our aim will be to keep the Site Inspections
within the hour. If inspections over-run the time limit, i.e. due
to safety matters/problems on site which you wish us to deal with,

Site Inspection fees are inclusive of all normal expenses i.e.
stationery, postage, telephone/fax charges and are based on
inspection being carried out in normal working hours 0730 am to
1800 pm.
To provide site inspections cost effectively and reliably, we need
one week minimum advance notice in writing where possible.
